I have the honor to acknowledge receipt of a Letter from W. Herbert of the 19th instant, in which, by your Lordship's direction, he informs me that my Letter of the 4th of July last had been referred on that day (19th) to the Governor of Hong Kong with a request that he will supply a calculation of the pension payable to me in accordance, as far as possible, with the Hong Kong Pension Minute,
but that my service in Hong Kong as Attorney General will not be counted for pension purposes.
Mr. Herbert mentions that your Lordship will grant authority to the Agents to pay to me, at the expiration of my leave of absence, a subsistence allowance at the rate of £1,200 per annum, subject to adjustment hereafter when the amount of my pension shall have been fixed.
I have respectfully submitted that when I entered the service of the Crown early in 1861, the Superannuation Act of 1859 constituted an effective Statutory Contract with me, as an Officer entering the service, entitling me to a pension to be measured by the provisions of that Act, and that that contract has not been repealed.
